These terms govern your use of StoffRent. By creating an account you accept them. Please read them: they say what we promise, what we do not, and how either of us can end the agreement.
We have tried to write them in plain language. Where a sentence sounds legal, it is because the law requires it to be there.
StoffRent is operated by StoffWare, Belgium, VAT BE 1040.174.154. You can reach us at contact@stoffrent.com or through the help form inside the application.
"We" and "us" mean StoffWare. "You" means the person or company holding the account.
StoffRent is software for private landlords. It keeps track of your properties, tenants and leases, calculates rent indexation from published index figures, generates documents from templates you control, stores your files, sends you reminders, and can publish listings for the properties you choose.
StoffRent is not an estate agency, a property manager, a law firm or an accountant. It gives you calculations and documents; the decisions, and the responsibility for them, stay yours.
You need an account to use StoffRent. Give us accurate details and keep them current. Keep your password to yourself; we strongly recommend turning on two-factor authentication.
A portfolio can have several members. Whoever owns the portfolio decides who joins it and with what role, and is responsible for what those members do in it. You must have the right to enter the personal data you add about tenants and other people.
You can start a 30-day free trial by choosing a plan and entering a payment card. Nothing is charged when the trial starts. During the trial the portfolio holds one property, with the premium features switched off.
You can cancel at any time during the trial from the billing page; nothing is then charged, and when the trial ends the portfolio becomes read-only. If you do not cancel, the subscription to the plan you chose starts when the trial ends, and its first period is charged on that day. We remind you of this before it happens.
There is one free trial per person and per payment card. A card that has already been used for a free trial, in any account, can still be used to subscribe, but without a new trial.
A read-only portfolio loses nothing: you can still read everything and download a complete export of your data at any moment.
Premium and Pro are sold as monthly or yearly subscriptions. The current prices are on the pricing page and are shown excluding VAT; the VAT that applies to you is added at checkout and shown before you pay.
Payments are handled by Stripe. We never see or store your card number. Your invoices are available in the billing section of the application.
A subscription renews automatically at the end of each period, until you cancel it. You can cancel at any time from the billing page; the subscription then runs to the end of the period you have already paid for, and is not renewed.
We do not refund periods that have started. If we raise prices, we will tell you at least 30 days beforehand, and the new price applies from your next renewal.
If a payment fails, we retry it for a few days and let you know. After that the portfolio becomes read-only until payment succeeds. If you take a payment back through your bank after using the service, we may cancel the subscription immediately.
If you are a consumer, EU law normally gives you 14 days to withdraw from a distance contract. Because StoffRent is a digital service that starts immediately, we ask you at checkout to confirm that you want it to start at once and that you accept losing your right of withdrawal once it has been fully performed.
We record that confirmation with its date and the wording you agreed to, and you receive a copy by email. If you would rather keep the 14 days, do not subscribe yet: the trial and the read-only mode let you take all the time you need to decide.
While using StoffRent, you must not:
If you do any of this, we may suspend the account. We will tell you why, and give you a chance to fix it whenever that is reasonable.
Everything you put into StoffRent remains yours. You allow us to host, process and display it for the sole purpose of running the service for you. We do not sell it, and we do not use it to train anything.
You can download a complete export of a portfolio at any time, including on an expired portfolio, from the settings page: all the data in open formats, plus your documents and photos.
When you are a landlord storing personal data about tenants, you are the controller of that data and we are your processor. Our data processing agreement sets out what that means; it forms part of these terms.
The software, the design and the StoffRent name remain ours.
StoffRent calculates rent indexation from official published index figures and the rules that apply to the lease you describe. We take that seriously and test it against real cases, but you remain responsible for checking a figure before you send it to a tenant, and for respecting the notice and eligibility rules that apply to you.
The contract generator is a document tool. The example template we ship is an example, not legal advice, and templates you add are entirely yours. Check what comes out before you sign it, and ask a professional when the situation is unusual.
We work to keep StoffRent available and correct, but we do not promise a particular uptime. Maintenance happens, and so do failures in the services we build on.
Support is through the help form in the application. We answer as quickly as we reasonably can; there is no contractual response time.
The service evolves. We may add, change or remove features. If we remove something you rely on, we will tell you in advance and, where the change is significant, give you at least 30 days' notice.
Nothing here limits our liability for fraud, for gross negligence or intent, for death or personal injury, or for anything else that Belgian law does not allow to be limited. Consumers keep every right their national law gives them.
Beyond that, our total liability towards you for any twelve-month period is limited to the amount you paid us during those twelve months. We are not liable for indirect or consequential loss: lost rent, lost time, lost profit, fines, or a decision you took on the basis of a figure or a document produced by the service.
You can stop using StoffRent whenever you like: cancel the subscription and, if you want, delete the account from the settings page. Export your data first; we cannot recover it afterwards.
We may end the agreement if you seriously breach these terms, or if you do not pay. Except in cases of abuse, we will give you notice and time to export your data.
After an account is closed, we delete its data within 90 days, except what we must keep by law (invoices, for the period the accounting rules require).
We may change these terms, for example when the service or the law changes. If a change affects you, we will tell you by email at least 30 days beforehand. If you keep using StoffRent after that, you accept the new version; if you do not want it, you can cancel before it takes effect.
Belgian law applies. If you are a consumer, this does not deprive you of the protection of the law of the country you live in.
Please write to us first: most problems are a misunderstanding, and we would rather fix it. If we cannot agree, the courts of the judicial district of Luxembourg (Arlon division), Belgium, have jurisdiction; consumers may also bring a case before the courts of their own place of residence.
